These Terms and Conditions govern your use of MartyK Printing (martykprinting.com.au), operated by MartyK Photography (ABN 96 747 561 563), located at 3B/104 Newmarket Rd, Windsor QLD 4030. By placing an order, you agree to these terms.
1. Orders and Acceptance
An order is not confirmed until payment is successfully processed. We reserve the right to cancel any order at our discretion and will provide a full refund in such cases. You will receive an email confirmation once your order is received and payment is confirmed.
You are responsible for ensuring the accuracy of images you upload, including correct orientation, crop, and resolution. We print what we receive — we do not make adjustments to your images unless specifically requested and agreed upon.
2. Image Quality
Print quality depends on the resolution of the image you supply. We display a resolution indicator during the ordering process. Orders placed with low-resolution images that may result in reduced print quality proceed at your own discretion. We are not liable for print quality issues caused by insufficient image resolution.
3. Pricing and Payment
All prices are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice; the price displayed at checkout is the price you pay.
Payment is processed securely by Stripe. We do not store your card details. A minimum order value may apply; a lab fee is added if your order is below the minimum.
4. Turnaround and Delivery
Standard turnaround is 2–5 business days from order confirmation, depending on current workload. Delivery is via courier and typically takes 1–3 additional business days within Queensland, and 3–7 business days for other Australian states and territories.
Turnaround times are estimates only and are not guaranteed. MartyK Printing is not liable for delays caused by couriers, circumstances beyond our control, or public holidays.
Pickup is available from Windsor QLD 4030 by arrangement. You will receive an email notification when your order is ready for collection.
5. Refunds and Reprints
Because photo prints are custom-made to your specifications, we do not offer refunds or returns for change of mind.
If your prints arrive damaged, or if there is a production error on our part (e.g. incorrect size, colour shift, or manufacturing defect), we will reprint your order at no charge. Please contact us within 7 days of receiving your order with a photo of the issue.
Refunds are issued as account credit by default. Cash refunds are provided at our discretion or where required by the Australian Consumer Law.
6. Intellectual Property and Image Rights
By uploading images for printing, you confirm that:
- You own the copyright to the images, or have permission from the copyright holder to reproduce them as prints.
- The images do not infringe any third-party intellectual property rights.
- The images do not contain illegal content.
We do not claim any ownership over images you upload. Your images are used solely to fulfil your order and are deleted from our servers after 7 days.
7. Account Security
You are responsible for maintaining the confidentiality of your account credentials. Please notify us immediately if you become aware of any unauthorised use of your account.
8. Limitation of Liability
To the maximum extent permitted by Australian law, MartyK Photography's liability for any claim arising from use of this service is limited to the value of the order giving rise to the claim. We are not liable for indirect, consequential, or special damages.
Nothing in these terms limits any right you have under the Australian Consumer Law.
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
